Terms and Conditions

These Terms and Conditions ("Terms") govern the services provided by Tether Technologies Pty Ltd (“we,” “us,” “our”) to clients (“you,” “your”). By using our services, you agree to be bound by these Terms. Please read them carefully.

1. Scope of Services

Tether Technologies Pty Ltd offers the following services:

  • Initial app development and deployment
  • Custom branding and customization
  • Training and onboarding
  • Technical support

Customizations after the initial delivery will be billed at a rate of $90 per hour. Updates and upgrades are included in the ongoing support package.

2. Payment and Billing

The initial fee for our service is $2,995, with an ongoing monthly fee of $99 for continued hosting, app store management, and support. Payments are due as per the invoicing schedule. A grace period of one month is provided for late payments; if payment is not made within this period, the app will be removed from all relevant app stores.

Refunds will not be offered after payment is completed due to the significant work involved in creating your custom mobile application.

3. Client Responsibilities

There are no obligations for clients to maintain the app post-development. However, clients must ensure timely payments to maintain app functionality and ongoing support.

4. Data Security and Confidentiality

All data collected through the app is secured and will not be shared with third-party developers. Data is stored in Google Firebase, which adheres to stringent security protocols, and all data transmission is encrypted using HTTPS.

No data processing agreement is required, as Tether Technologies Pty Ltd does not process client data beyond secure storage.

5. Support and Maintenance

Support services are available Monday to Friday, 9:00 am to 5:00 pm AWST. Emergency support will be provided on a case-by-case basis at Tether Technologies’ discretion. There is no Service Level Agreement (SLA).

6. Termination

The agreement can be terminated by Tether Technologies Pty Ltd in the event of non-payment or breach of contract. Upon termination, the app code will be destroyed, and the app will be removed from all stores.

7. Liability and Disclaimers

Tether Technologies Pty Ltd guarantees an uptime of at least 99%; however, this is not a warranty. No warranties are provided regarding the functionality or performance of the app post-deployment.

We are not liable for any actions performed on the app or any damages incurred as a result of its use. Responsibility for app usage, participant interactions, and responses lies solely with the provider. By using our service, you agree to indemnify Tether Technologies Pty Ltd from any and all claims, liabilities, or damages.

8. Amendments and Acceptance

Tether Technologies Pty Ltd reserves the right to amend these Terms at any time. Continued use of our services constitutes acceptance of any updated Terms.
